We, MAKATI FINANCE CORPORATION (“MFC” or “Corporation”), respect your personal data privacy. We value and protect the confidentiality of your personal data by committing to comply with the Republic Act No. 10173, otherwise known as the “Data Privacy Act of 2012”, its implementing rules and regulations, issuances, policies and other applicable laws. Under the Data Privacy Act of 2012, Personal Information refers to any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

Why does MFC collect and process your Personal Information?

MFC generally collects your Personal Information for the following purposes:

  • to manage and administer the business operations of the Corporation;
  • to document and manage the records of the Corporation;
  • to market, increase the sales or advertise the business of the Corporation; and
  • to determine demographics on usage of products and registration to the Corporation’s services and for internal operation purposes of the Corporation such as purchasing and accounting transactions, billings purposes and records management.

If you are a client of MFC, your personal data shall be used for the following purposes:

  • to create, update, and/or maintain a record or profile in the Corporation’s processing system;
  • to inform the Data Subject of the approval of his or her loan and release of the cash or motorcycle.
  • to prepare and execute the necessary loan or mortgage contracts or documents;
  • to communicate any changes or such other information affecting the Data Subject’s contract with MFC;
  • to send notices and demand letters;
  • to file small claims or collection cases against delinquent clients;

If you are a prospective client or loan applicant of MFC, your personal data shall be used for the following purposes:

  • to create, update, and/or maintain a record or profile in the Corporation’s processing system;
  • to conduct appropriate background and credit investigation to assess the risk of transacting with the Data Subject;

 to evaluate and process the loan application;

  • to approve or disapprove the loan application and to inform the Data Subject of such decision;

If you are an officer, employee, personnel or staff of MFC, your Personal Information shall be used for the following purposes:

  • to create, update, and/or maintain the employment records;
  • to ensure that the Data Subjects are qualified and suitable for the job they were assigned to;
  • to evaluate his job performance, progress and development in MFC;
  • to process his or her separation or retirement pay;
  • to implement disciplinary procedures upon Data Subject, if necessary;
  • to provide financial assistance or such other assistance in case of emergency; and
  • to enable the Corporation to pay or remit government mandated contributions or premiums.

If you are a prospective employee or job applicant, your Personal Information shall be used for the following purposes:

  • to evaluate his or her suitability for employment and, with a written or expressed consent, retain his or her Personal Data for a period of three (3) years for future job opportunities;
  • to communicate with the Data Subject about the status of his or her employment application; and
  • if accepted and employed, the Personal Data shall be used for the same purpose when you are already an officer, employee, personnel or staff of MFC.

If you are a vendor/supplier, potential vendor/supplier and contractor, your Personal Information shall be used for the following purposes:

  • to accredit you;
  • to conduct due diligence;
  • to inform you of the acceptance or denial of your proposals or contractual arrangements;
  • to obtain your services; and
  • to perform any other action as may be necessary to implement the terms and conditions of the contract with you.

If you are a stockholder, your Personal Information shall be used for the following purposes:

  • to maintain and update your records with the Corporation;
  • to record any sale, transfer, assignment, donation, pledge of your shares of stock in the Corporation;
  • to declare you delinquent in accordance with the Revised Corporation Code of the Philippines;
  • to comply with the monitoring requirements of the Securities and Exchange Commission and other applicable government agencies; and
  • to comply with other legal, regulatory and contractual requirements or obligations of the Corporation.

If you are a visitor or guest of the Corporation’s premises or any of the Corporation’s websites, your Personal Information shall be used for the following purposes:

  • to grant access to the premises or website;
  • to record the number of visits in the Corporation’s website; and
  • to maintain the security in the premises and the website.

What Personal Information does MFC collect?

MFC collects the following:

  • Personal Information, which includes but not limited to, name, home address, email address, telephone or mobile number.
  • Sensitive Personal Information, such as but not limited to, race, marital status, age, Social Security System number.

Please note that you are responsible for ensuring that the Personal Information you provided are correct, accurate, complete and updated. Should you be made aware of any incorrectness, inaccuracy or incompleteness in the Personal Information previously provided to us or should you need to update your Personal Information, kindly notify us at the contact hereunder.

How does MFC collect your Personal Information?

MFC collects your Personal Information when you knowingly and voluntarily:

  • visit the office or website and fill up the registration/application form;
  • fill up the registration form during the events/seminars where MFC is a participant;
  • submit your loan application form;
  • provide information during credit and background investigation;
  • email or send your resumes, curriculum vitae, profile, contracts, agreements or other document containing your Personal Information;
  • attend conferences where MFC is a participant; and
  • contact or enter into transactions with MFC.

To whom does MFC share your Personal Information?

MFC will not share your Personal Information without your consent. Thus, by providing your Personal Information, it is understood that you hereby authorize MFC to disclose your Personal Information to an affiliate of MFC or to third parties necessary for the proper execution of processes related to the purposes of the MFC or as required or authorized by or under law.

How does MFC protect and value your Personal Information?

We are committed to protect and ensure the security of any Personal Information you provide to us. We strictly implement reasonable and appropriate physical, technical, and organizational measures to protect such information against natural dangers such as accidental loss or destruction, and human dangers such as unauthorized access or disclosure, fraudulent misuse, unlawful destruction, alteration and contamination.

All officers, employees, personnel and staff of MFC shall maintain the confidentiality and secrecy of all Personal Information that come to their knowledge and possession, even after resignation, termination of contract, or other contractual relations.

Where does MFC store the Personal Information collected and processed?

We store your Personal Information at our business office, cloud storage or information system service provider by implementing of technical solutions, security practices and processes such as but not limited to (1) using a secured server behind a firewall, (2) deploying encryption on computer devices (3) restricting access to your Personal Information only to Authorized Personnel.

How long does MFC keep and dispose the Personal Information collected and processed?

Your Personal Information shall be retained only for as long as necessary to fulfill the declared and specified purpose of MFC and to establish or exercise legal claims or to perform legitimate business purposes. After the lapse of the retention period, the Personal Information, in physical or electronic form, shall be disposed of and destroyed through secured means to avoid accidental, unlawful or unauthorized usage of Personal Information.
